Mental Health Worker Banned After Misconduct Findings

A Mental Health nurse has been struck off the professional register after a tribunal found evidence of misconduct regarding conversations about the country’s most vulnerable patients inside a high-security psychiatric unit. Emma Elizabeth Doherty, a deputy ward manager at the Edenfield Centre in Prestwich, is one of a number of workers sacked after an undercover investigation televised by Panorama highlighted the issues at the hospital.  The findings led to the unit being closed to new admissions while multiple investigations were carried out.

Comments About Patients Raised Serious Concerns

The tribunal heard that the recordings show Ms Doherty making unpleasant comments about a patient, Service User A. The patient was mentioned in relation to needing physical punitive measures. They were also discussed in relation to changing their ways through imprisonment and facing restrictions.

Ms Doherty was heard commenting that there was no will for anything else to be offered from the staff side in her regards. In a professional capacity, the language used towards a vulnerable patient under her Mental Health remit was said to be very dismissive. It also showed a severe lack of empathy.

Further Remarks Added To Concerns

In addition to remarks about Service User B, whom Ms Doherty apparently viewed in negative terms, Ms Doherty’s panel was aware of discussions taking place between other staff members. During these discussions, detrimental references were made regarding the patient.

However, the panel took the view that it was inappropriate for Ms Doherty to ignore comments made by another colleague about the patient. Given her seniority on that particular occasion, the panel believed that she ought to have challenged such conduct.

Impact On Patients And Families

The council’s representatives, speaking at the hearing, revealed that the probe has greatly impacted families and patients, several of whom were clearly shaken listening to the exchanges. Staff reportedly used dehumanizing and disrespectful language, according to the council. The local authority said the comments could cause emotional harm to those described and undermine public confidence in mental health services

Nurse Described Workplace Challenges

In her evidence to the committee Ms Doherty told that she was ashamed of what she did and apologised for what she said. Ms Doherty said the working conditions had been very challenging in the Edenfield Centre and often staff came under pressure due to a lack of support and staffing resources. Ms Doherty also said many of the staff were left demoralised and burned out due to the persistent workforce pressures, and that staff had made many concerns about staffing, with few improvements.

Tribunal Reaches Final Decision

They reached this conclusion having considered all of the evidence, which was of the view that her behaviour, together with the words that she had said, was incompatible with the practice of a registered nurse. I recognise that in carrying out their work, nurses are from time to time faced with difficult situations that arise from their employment. Her unjustified behaviour did not just put her patients at risk of humiliation and embarrassment. Panel members took the view that it brought the nursing profession into disrepute. Accordingly, Ms Doherty was guilty of professional misconduct. The outcome being that Ms Doherty had her name removed from the register of nurses. This means that Ms Doherty can not at any time thereafter work as a registered nurse in the United Kingdom.

Ongoing Focus On Patient Safety

The trial has also been instrumental in increasing attention to mental health care standards and safety for patients. Patients still need to be able to feel treated well with respect, from the eyes of health watch dog agencies. These agencies continue to stress that there must be professional, courteous and caring treatment of each patient at all times.
